Welcome to Shorera Luxury Yacht Tours. These Terms and Conditions govern your use of the Shorera website (https://shorera.com) and all related services, including but not limited to yacht tours, charters, and experiences provided by Shorera Luxury Yacht Tours ("Shorera", "we", "us", or "our").
By accessing our website, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
We reserve the right to modify these Terms and Conditions at any time without prior notice. Your continued use of our website or services after any changes indicates your acceptance of the modified terms.
Unless otherwise stated, Shorera and/or its licensors own the intellectual property rights for all material on the Shorera website. All intellectual property rights are reserved. You may view and/or print pages from https://shorera.com for your own personal use, subject to the restrictions set out in these terms and conditions.

In these Terms and Conditions, "User Content" means material (including, without limitation, text, images, audio, video) that you submit to our website, for whatever purpose.
You grant Shorera a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your User Content in any existing or future media. You also grant Shorera the right to sub-license these rights and the right to bring an action for infringement of these rights.
Your User Content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action against you or Shorera.
Shorera reserves the right to edit or remove any material submitted to our website, or stored on our servers, or hosted or published on our website.
All bookings for Shorera yacht tours and experiences must be made through our website, by telephone, or by email. A booking is confirmed only after receipt of a deposit or full payment (as specified at the time of booking) and our written confirmation.
Bookings can only be made by persons 18 years of age or older. Minors (under 18 years) must be accompanied by a parent or legal guardian during all yacht tours and experiences.
A non-refundable deposit of 25% of the total tour price is required at the time of booking to secure your reservation. The remaining balance must be paid in full at least 60 days prior to the scheduled departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
We accept payment by major credit cards (Visa, MasterCard, American Express), bank transfer, and other methods as specified during the booking process. All payments must be made in Canadian Dollars (CAD).
Upon receipt of your deposit or full payment, we will send you a booking confirmation via email. This confirmation will include details of your tour, departure date, itinerary, and any special arrangements. It is your responsibility to review this information and notify us of any errors or discrepancies immediately.
All prices are quoted in Canadian Dollars (CAD) and include applicable taxes. Prices are subject to change without notice until your booking is confirmed. Once your booking is confirmed, the price is guaranteed, except for changes resulting from government action, such as changes in taxes or fees.

Shorera reserves the right to cancel, delay, or alter any tour or experience due to weather conditions, safety concerns, or other circumstances beyond our control. In such cases, we will offer you the option to reschedule for another date or receive a full refund of the amount paid.
If a tour is shortened or altered due to weather or safety concerns after it has commenced, refunds will be provided on a pro-rated basis at Shorera's discretion.

In such cases, no refund will be provided, and the guest may be responsible for any additional costs incurred as a result of their behavior, including but not limited to damage to the yacht or equipment.
Guests will be held financially responsible for any damage to the yacht, its equipment, or furnishings caused by their negligence, willful act, or failure to follow crew instructions. This includes, but is not limited to, stains, tears, breakage, or structural damage.
Yacht tours involve physical activities and exposure to marine conditions. You should be in reasonable physical health to participate. It is your responsibility to disclose any health conditions, allergies, or mobility limitations that may affect your ability to participate safely in the tour activities.
Pregnant women and individuals with certain medical conditions may be advised not to participate in some activities. Please consult your healthcare provider before booking if you have any concerns about your ability to participate safely.
For your safety and the safety of others, you must attend all safety briefings provided by the crew and follow all safety instructions during the tour. Failure to comply with safety instructions may result in your removal from the tour without refund.
Life jackets and other safety equipment are provided on all our yachts. You must wear a life jacket when instructed to do so by the crew, particularly during water activities or in adverse weather conditions.
Swimming, snorkeling, and other water activities are undertaken at your own risk. You should be a competent swimmer to participate in these activities. Children must be supervised by an adult at all times during water activities.
It is your responsibility to ensure that you have all necessary travel documents, including valid identification, passports, visas, and permits as required. Shorera is not responsible for any issues arising from inadequate or improper documentation.
We strongly recommend that all guests purchase comprehensive travel insurance that includes coverage for trip cancellation, medical emergencies, evacuation, personal injury, and property damage. Shorera is not responsible for any losses, damages, or expenses incurred as a result of your failure to obtain adequate insurance coverage.
You acknowledge that yacht tours and maritime activities involve inherent risks, including but not limited to exposure to weather conditions, motion of the vessel, and various marine hazards. You voluntarily assume all such risks when booking and participating in our tours.
To the maximum extent permitted by law, Shorera and its owners, directors, officers, employees, and agents shall not be liable for any indirect, special, incidental, or consequential damages arising from your use of our services or website, even if we have been advised of the possibility of such damages.
Our total liability to you for all losses, damages, and causes of action, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the specific tour or service that gave rise to the claim.
Shorera shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, weather conditions, governmental actions, labor disputes, civil unrest, or mechanical failure.
All content on the Shorera website, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Shorera or its content suppliers and is protected by Canadian and international copyright laws.
The Shorera name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Shorera or its affiliates. You may not use these marks without our prior written permission.
Shorera may take photographs or videos during tours for promotional and marketing purposes. By participating in our tours, you grant us permission to use images or videos in which you appear for our marketing materials, website, social media, and other promotional purposes without compensation.
If you do not wish to be photographed or filmed, please notify our crew at the beginning of your tour.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without giving effect to any principles of conflicts of law.
Any dispute arising under or related to these Terms and Conditions shall be resolved exclusively in the courts located in New Brunswick, Canada. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction by such courts.
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Such invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
